  • How Shall We Impeach Thee? Let Us Count the Ways, Part V

Happy New Year! 2020 has arrived and with that there is much work that needs doin’ to safeguard our democracy. Make no mistake, even though Trump was impeached by the House in a vote mostly among party lines, it’s now more important than ever to write or call your senators and let them know you want to see a fair trial in the Senate (see below for easy ways to connect to them).

The trial in the Senate will commence when the Articles of Impeachment are sent from the House. Presently, Madame Speaker Nancy Pelosi and Senate Majority Leader Mitch McConnell are at an impasse, due in part to McConnell rejecting the Democrats call for witnesses and his stunning statement that he will fully coordinate with the White House. Both Senator Susan Collins of Maine and Lisa Murkowski of Alaska have voiced concerns with McConnell’s lack of impartiality. Pelosi noted in her subsequent speech after the final House impeachment vote, that the House will come to a consensus as to when the Articles will be sent and only when Pelosi is satisfied that the American people will have a fair trial.

There are four possibilities for how the Senate trial shakes out:  a. There is no trial, at least not in 2020. However, this is the least likely outcome because the Constitution calls for a trial in the Senate after an impeachment in the House.  b. Pelosi gets her way and McConnell calls witnesses. c. McConnell gets his way and has a speedy trial that works in Trump’s favor. d. There is a compromise.

It’s anybody’s guess at this point. Over the holiday there has been additional news that could work in the Democrats favor.  For the details, read the Washington Post article.

In the meantime, Pelosi invited Trump to make the State of the Union address on February 4th. What’s interesting about this invite is the very possibility of the trial looming over Trump’s head. What will the State of the Union address look like? If we don’t want to see a victory speech, we MUST CALL our senators EVERY DAY and HOUND them.

Again, here is what you can do:

    • Right now, phone the U.S. Capitol Switchboard at (202) 224-3121. A switchboard operator will connect you directly with the Senate office you request. Tell them you want a fair trial in the Senate and not to be held hostage to the GOP circling the wagons around the White House to protect a blatantly corrupt president.
    • You can also access the Indivisble.org webpage to connect you. Indivisible Senator contact page
    • In addition, be on the ready for another rapid response action. Literally drop everything and take to the streets when the Senate verdict is nigh. It’s imperative that we are loud and visible to make known that the PEOPLE want Trump IMPEACHED & REMOVED.

As we shook off the tryptophan induced coma, the House Intelligence Committee voted 13-9 to issue its 300-page report of the impeachment investigation findings. Released on December 3, all findings were garnered via testimony of government employees who had knowledge of the call between Trump and President Zelensky of the Ukraine. In this “perfect” call, Trump suggested withholding military aid to the Ukraine unless Zelensky agreed to launch an investigation into the Bidens, Trump’s potential 2020 campaign opponent.

The Harvard-educated committee chairman, Adam Schiff, proved worthy of his juris doctorate by rounding out an excellent line of questioning with astute commentary and summarizations of the day.  Devin Nunes however, had nothing but Russian talking points that he excessively repeated and did nothing except further prove that Trump’s actions are indefensible. Gym Jordan demonstrated exactly why he never passed the bar.  His fist pounding and yelling was more empty bravado or rather, much ado about nothing. Lt. Col. Vindman and Fiona Hill shall go down in the history books as true patriots. Sondland, on the other hand, may be noted for saving his own hide by throwing everyone under the bus.

The truth of the matter is, Trump’s actions re the Ukraine “perfect” call are indefensible. The Constitution and the law safeguard the American republic from such illegality and point squarely to impeachment of the <cough> president for the actions he took. As Schiff duly noted in the draft report, “In his farewell address, President George Washington warned of a moment when “cunning, ambitious, and unprincipled men will be enabled to subvert the power of the people and to usurp for themselves the reins of government, destroying afterwards the very engines which have lifted them to unjust dominion.”  The report makes clear from its findings that Trump has abused his presidential powers. You can read it here: HIC Draft Report

The next round of hearings began December 4 to lay bare the information in the report. Four constitutional law experts, Noah Feldman, Pamela Karlan, Michael Gerhardt and Jonathan Turley, testified as to the merits of the report and why this is a case for impeachment. Dec. 4 Hearing Highlights   On Wednesday, December 5, House Speaker Nancy Pelosi gave the House the go-ahead to proceed with impeachment. What comes next is drafting the articles of impeachment upon which the House will vote and is likely to pass. Once the articles of impeachment pass the House, it goes to trial in the Senate. Chief Justice Roberts will preside over the Senate trial.

Of note, are the numerous people who spent countless hours behind the scenes transcribing, drafting and editing this document for American public to read. They too, are heroic. They are the unsung heroes and deserve as much recognition as Schiff and Pelosi for their hard work and dedication.

Again, here is WHAT YOU CAN DO.  Be ready for the RAPID RESPONSE action. On the eve of the House vote, join us in front of Rep. Brian Fitzpatrick’s Langhorne office. Drop everything and take to the streets when the eve of the House vote is nigh. It’s imperative that we are LOUD & VISIBLE to make known that we want Trump IMPEACHED & REMOVED. More info to come!

  • Impeach and Remove! Rapid Response Readiness Reminder – PLEASE READ

The night before the House of Representatives takes a historic vote to impeach Trump, we’ll head to every congressional office and public square to declare that Nobody Is Above the Law as representatives finalize their positions and senators look on.

Indivisible Lambertville/New Hope is planning to turn out in force at Representative Brian Fitzpatrick’s Langhorne, PA office. The protest is scheduled to start at 5:00 pm.

If there has ever been an event where we need to have a huge turnout in front of Rep. Fitzpatrick’s office, it is this one. He is one of only three or four vulnerable Republican MoCs in the whole country who can conceivably be convinced to vote against his party.  He needs to see where the people of this area stand. And that will only happen if there is a tremendous crowd in front of his office building, chanting, bearing posters, and making it abundantly clear that they support impeachment. Come out. Bring friends. Please prioritize this rapid response event.

We don’t know the exact date when this will occur, but could be nearly anytime in the next month.  So be ready! This means making your signs, coordinating transportation with others. If you haven’t already registered for the event – which is one of 345 planned events around the country – do so at the link below. You can also find other registered events in NJ and PA if getting to Langhorne is too much of a challenge. Sign up for an event here: https://www.impeach.org/event/impeach-and-remove-attend/search/

If you’re feeling like your head is on a swivel with the increasing pace of the impeachment news, you’re not alone. Since September 24 it’s been fast and furious, as the crescendo builds with public hearings beginning this past week. Here is a link to The Guardian’s timeline of impeachment events

Breaking Nov. 9th:  Lt. Col. Alexander Vindman who serves as the Director for European Affairs for the United States National Security Council was called to testify before the House Judiciary Committee. Vindman was privy to the July 25th call between Trump and the Ukraine’s President Zelensky. Vindman testified that he expressed concerns regarding Trump’s quid pro quo wherein Trump said he would release aid to the Ukraine in exchange for dirt on Biden’s son.  You can read the Oct. 29 transcript here. Lt. Col. Alexander Vindman’s testimony

Also Fiona Hill’s transcripts were released. Hill confirmed during a “July 10 sit-down between Trump administration officials and Ukrainian officials, that the Ambassador to the EU Gordon Sondland “blurted out” that there was an agreement: Ukraine’s president would get a meeting with President Donald Trump, if Ukraine agreed to launch certain investigations.”  ~Vox  You can read the Oct. 14 transcript here. Fiona Hill’s testimony

Many key players who have first hand knowledge of Trump’s quid pro quo with Ukraine’s Zelensky are defying subpoenas to testify. Refusing to appear Nov. 1, Rick Perry, outgoing Energy Secretary. As of Nov. 4, John Eisenberg, deputy counsel to the president for national security affairs; Robert Blair, a senior adviser to acting White House chief-of-staff Mick Mulvaney; Michael Ellis, Mr. Eisenberg’s deputy; and Brian McCormack, an associate director at the White House budget office. ~WSJ And as of Nov. 7 Trump’s former National Security Advisor John Bolton refused to appear before the HIC. ~USA Today, and finally on Nov. 13, the first day of public hearings, acting Chief of Staff Mick Mulvaney said he will follow White House orders not to appear.

And the hits keep on coming.

Here’s WHAT YOU CAN DO.  See actions below and be on the ready. We don’t know exactly when these vigils, rallies and protests will take place, since they’re timed to the House Impeachment vote. When it happens, drop everything and take to the streets with ILNH or other organizations planning events. It’s imperative that we are LOUD & VISIBLE to make known that we want Trump IMPEACHED & REMOVED. More info to come!

    • Rolling Impeachment Vigil – Volunteer organizer(s) and planning team needed!

A coalition of NJ Indivisible groups is planning to hold rolling impeachment vigils at several locations across the state. Indivisible Lambertville/New Hope would like to host one, however, we are in need of somebody, or several somebodies,  to take the reins on organizing.

The format of the vigil is up to the hosting organization. It could be a rally, protest or a march, with or without speakers. Timing is still TBD, but likely before Christmas.

Anyone interested in taking the lead or co-lead on this should contact Karen Mitchell, who’s our liaison to other NJ Indivisibles.

    • “Nobody is Above the Law” Impeachment Vote Rapid Response

ILNH is joining forces with Indivisibles from Bucks for a “Nobody is Above the Law” rapid response rally. The night before the House of Representatives takes a historic vote to impeach Trump, people and organizations across the nation will head to every congressional office and public square to declare that Nobody Is Above the Law as representatives finalize their positions and senators look on.

Events will be visible, family-friendly, public gatherings to demonstrate to our lawmakers that their constituents are behind them to defend the Constitution—and that Trump has left them no alternative to uphold their oath of office but to support impeachment and removal.

THE ILNH PLAN: At 5 pm on the eve of the vote, as many people as possible will gather at Rep. Brian Fitz’s Langhorne office at 1717 Langhorne-Newtown Rd. Suite 400, Langhorne, PA 19047. WE WANT BIG NUMBERS. Reminder to obey all public safety and traffic laws and do not put yourself or anyone else at risk. Volunteers are needed to help with marshalling the group. Contact Cindi Sternfeld to volunteer.

ACT NOW: Start making your signs now since we don’t know the exact date of the vote and the time between alert and action will be short.  Bonus points for those who decorate their vehicles and come up with super-creative ideas. We are currently considering a sign-making night in Lambertville, TBD. We will also welcome anyone who wants to make (Im)PEACH(ment) goodies to share with the crowd. Or send to Fitz.

Check out these resources from MoveOn.org, including graphics files for downloading and signage making.

  • How Shall We Impeach Thee? Let Us Count the Ways – Part II

    Contributed by Paige Barnett.

Trump violates campaign finance laws by paying hush money to two women and instructs his attorney to lie about it to congress; an indictable offense.

    Resistance: Impeach now?  Pelosi: No.

Trump refuses to divest himself of his daily on-going business deals, which are conflicts of interest to his oath of office to the presidency; a violation of the Emoluments Clause of the U.S.Constitution.

Resistance: How about now?  Pelosi: No.

April 18, 2019 – The Mueller Report is released. The report clearly establishes 10 ways in which Trump potentially obstructed justice. Mueller testifies that Trump is indictable and that Trump is not exonerated.

Resistance: NOW?!  Pelosi: No. Resistance: Geez! Come on already!

If you’ve read the Mueller report, you know it’s damning.  It left many wondering what it would take for the House Speaker to initiate impeachment hearings if these offenses weren’t enough. Pelosi continually said that she needed public consensus to build the case for impeachment, and now, that is happening.  At the time this piece was written, there’s been a 9 point surge in support of impeaching Trump according to a Monmouth University poll.

Finally, on September 24 Pelosi announced an impeachment inquiry of Trump would begin with multiple House Committees joining forces under one inquiry. The trigger? A whistleblower’s report of Trump’s “perfect call” with the Ukraine President Zelensky wherein Trump implies a quid pro quo; a favor to investigate his 2020 presidential opponent.  In effect, for his own personal gain, Trump is using his power as President of the United States to withhold aid to the Ukraine in exchange for dirt on Biden and his son, Hunter. You can read the transcript here

Ever since, a flood of news breaks nearly hourly about the Trump/Zelensky call, ranging from the RNC’s inadvertent email highlighting talking points to downplay the intent and context of the call to the storing of the hiding the transcript on a separate, classified server, Trump’s threats (an impeachable offense in and of itself) to the whistleblower and to arrest House Intelligence Committee Chair, Adam Schiff – another impeachable offense. Let us not forget Trump saying Pelosi is no longer Speaker among his tsunami of twitter rants, and so much more our heads are spinning.

Now, Trump is calling for Civil War if the impeachment continues. For fun, check out the #CivilWarPotLuck threads on Twitter. I’ll be bringing peach cobbler. How about you? On Tuesday night he called the impeachment hearings an attempt at a coup.

The House Judiciary, Intelligence and Oversight Committees are tasked with investigating the allegations against Trump.  Details here. Schiff and the other chairman are fast tracking the inquiry by subpoenaing Trump’s inner circle for documents and testimony. However, as has happened in the past, key witnesses are being told to refuse to testify or answer the subpoenas. Secretary of State Pompeo is accused of witness intimidation as he attempts to block or at least delay State Department employees from testifying.

As of this moment, Grassley (R-IA) broke rank with Trump stating the whistleblower’s identity should be kept confidential. Former Senator Jeff Flake (R-AZ) is calling upon all Republicans to “save their souls” and do the right thing. According to sources, there are a number of Senate Republicans who would vote to impeach Trump if the vote were kept secret.

All the while, US Attorney General William Barr flew to Italy probing Australia, the UK, the Ukraine and Italy.  No one really knows why but conjecture it’s to prop up a conspiracy about who or what associated with the US Intelligence community or the Democratic party motivated the Mueller investigation as an attempt to impugn the report’s credibility.

What’s more, overall consensus by the public to impeach is developing daily and the “wall” around Trump appears to be crumbling. Suffice it to say, news is coming at a breakneck pace. We shall see how this all plays out. One thing is for sure, a President, the Attorney General and the Secretary of State are not above the law.

    …..to be continued.
